Ruth Bader Ginsburg, Associate Justice of the US Supreme Court, joined the Aspen Wye Fellows to discuss her book My Own Words, a collection of her writing and speeches. Upon her appointment to the Court in 1993, Justice Ginsburg became the second female justice in US history.

Justice Ginsburg enjoyed a career as a professor and advocate for gender equality and women’s rights before she took a seat on the Supreme Court. She was a fierce proponent of the Equal Rights Amendment, which was designed to guarantee gender equity. The amendment was never ratified, but has recently seen renewed interest after the Women’s March on Washington this year. (2017)

Roe v Wade Roe v. Wade was a landmark legal decision issued on January 22, 1973, in which the U.S. Supreme Court struck down a Texas statute banning abortion, effectively legalizing the procedure across the United States. The court held that a woman’s right to an abortion was implicit in the right to privacy protected by the 14th Amendment to the Constitution. Prior to Roe v. Wade, abortion had been illegal throughout much of the country since the late 19th century.

Just three years after the Parker decision, the government’s MMAR regime was under the Supreme Court’s microscope. Several individuals argued that access to medical cannabis was too restricted and infringed on their Charter rights. Parker gave these people a right to use cannabis for therapeutic purposes.

The government was supposed to have created a legal market for medical users. Instead, the Supreme Court noted, individuals had to seek cannabis on the black market. This put them at risk of breaking the law and going to prison and thus constituted an infringement of the right to liberty.

When the science of cannabis came before the Supreme Court in 2003, it was loathe to assess the evidence presented to it. “The question before us,” it stated, “is purely a matter of law.” Despite such statements, Canadian courts have consistently looked to the science to inform their decisions.

WHO RECOMMENDATIONS ON CANNABIS

In 2019 WHO recommended the rescheduling of cannabis and cannabis-related substances. Consultations on these recommendations by the CND are ongoing.

Following the 41st meeting of the WHO Expert Committee on Drug Dependence (ECDD), WHO recommended in 2019, the rescheduling of cannabis and several cannabis-related substances. The Commission on Narcotic Drugs decided during its 62nd session in March 2019 to postpone the voting on the recommendations to provide Member States with more time.

During the 4th and 5th Intersessional Meeting of the Commission on 24 June 2019 and 23 September, Member States were given the opportunity to address questions to WHO. The International Narcotics Control Board (INCB) and UNODC were also present to provide answers within their respective mandates.

During its 63rd session, the Commission decided to continue considerations of the recommendations and to vote during the 63rd reconvened session in December 2020.
